Слушания ОП РФ: "Защита прав предпринимателей"

24 декабря, в понедельник Комиссия по проблемам безопасности граждан и взаимодействию с системой судебно-правоохранительных органов Общественной палаты РФ провела слушания на тему: «Защита прав предпринимателей». Вопросы совершенствования российского законодательства в области защиты прав предпринимателей обсуждались на примере анализа явно сфабрикованного уголовного дела против индивидуального предпринимателя Руслана Телкова, который почти год необоснованно содержится в СИЗО. В слушаниях приняли участие представители Верховного Суда РФ, депутаты Государственной Думы РФ, члены Совета Федерации и Общественной палаты РФ, представители федеральных органов исполнительной власти, адвокаты, представители общественных организаций. По мнению присутствующих, дело Руслана Телкова является во многом типичным с точки зрения необоснованного уголовного преследования предпринимателей, инициированного недобросовестными конкурентами при поддержке заинтересованных правоохранительных структур. Данное уголовное дело показывает несовершенство ряда положений УПК и УК РФ, касающихся вещественных доказательств, оперативно-розыскной деятельности, разграничения статей 146 и 147 УК РФ, ответственности следственных и судебных органов при избрании меры пресечения предпринимателям и ряда других положений. Участники мероприятия отметили, что вступивший в силу, принятый Госдумой пакет поправок в ст. 159 «Мошенничество» Уголовного и Уголовно-процессуального кодексов России, является большим шагом вперед. И для дальнейшего обсуждения и решения вопросов совершенствования российского законодательства в области защиты прав предпринимателей, собравшимся, объединившись, предстоит провести большую совместную работу, вынося проблему на открытое общественное обсуждение.

Крупской. Среди главных организаторов встречи - председатель комитета по собственности, природопользованию и строительству Александр Соляник.

The Waste Isolation Pilot Plant, or WIPP, is the world's third deep geological repository (after closure of Germany's Repository for radioactive waste Morsleben and the Schacht Asse II Salt Mine) licensed to permanently dispose of transuranic radioactive waste for 10,000 years that is left from the research and production of nuclear weapons. It is located approximately 26 miles (42 km) east of Carlsbad, New Mexico, in eastern Eddy County. In order to address growing public unrest concerning construction of the WIPP, the New Mexico Environmental Evaluation Group (EEG) was created in 1978. This group, charged with overseeing the WIPP, verified statements, facts, and studies conducted and released by the DOE regarding the facility. The stewardship this group provided effectively lowered public fear and let the facility progress with little public opposition in comparison to similar facilities around the nation such as Yucca Mountain in Nevada. The EEG, in addition to acting as a check for the government agencies overseeing the project, acted as a valuable advisor. In a 1981 drilling, pressurized brine was again discovered. The site was set to be abandoned when the EEG stepped in and suggested a series of tests on the brine and the surrounding area. These tests were conducted and the results showed that the brine deposit was relatively small and was isolated from other deposits. Drilling in the area was deemed safe due to these results. This saved the project valuable money and time by preventing a drastic relocation. In 1979 Congress authorized construction of the facility. In addition to formal authorization, Congress redefined the level of waste to be stored in the WIPP from high temperature to transuranic, or low level, waste. Transuranic waste often consists of materials which have come in contact with radioactive substances such as plutonium and uranium. This often includes gloves, tools, rags, and assorted machinery often used in the production of nuclear fuel and weapons. Although much less potent than nuclear reactor byproducts, this waste still remains radioactive for approximately 24,000 years. This change in classification led to a decrease in safety parameters for the proposed facility, allowing construction to continue at a faster pace. The first extensive testing of the facility was due to begin in 1988. The proposed testing procedures involved interring samples of low level waste in the newly constructed caverns. Various structural and environmental tests would then be performed on the facility to verify its integrity and to prove its ability to safely contain nuclear waste. Opposition from various external organizations delayed actual testing into the early 1990s. Attempts at testing were resumed in October 1991 with US Secretary of Energy James Watkins announcing that he would begin transportation of waste to the WIPP. Despite apparent progress on the facility, construction still remained costly and complicated. Originally conceptualized in the 1970s as a warehouse for waste, the repository now had regulations similar to those of nuclear reactors. As of December 1991, the plant had been under construction for 20 years and was estimated to have cost over one billion dollars. At the time, WIPP officials reported over 28 different organizations claiming authority over operations of the facility. In November 1991, a federal judge ruled that Congress must approve WIPP before any waste, even for testing purposes, was sent to the facility. This indefinitely delayed testing until Congress gave its approval. The 102nd United States Congress passed legislation allowing use of the WIPP. The House of Representatives approved the facility on October 6, 1992 and the Senate passed a bill allowing the opening of the facility on October 8 of the same year. The bill was met with much opposition in the Senate. Senator Richard H. Bryan fought the bill based on safety issues that concerned a similar facility located in Nevada, the state for which he was serving as senator. His efforts almost prevented the bill from passing. New Mexico senators Pete V. Domenici and Jeff Bingaman effectively reassured Senator Bryan that these issues would be addressed in the 103rd Congress. The Los Angeles Police Department (LAPD) is the police department of the city of Los Angeles, California. The LAPD has been copiously fictionalized in numerous movies, novels and television shows throughout its history. The department has also been associated with a number of controversies, mainly concerned with racial animosity, police brutality and police corruption. The radio show Calling All Cars hired LAPD radio dispacher Jesse Rosenquist to be the voice of the dispatcher. Rosenquist was already famous because home radios could tune into early police radio frequencies. As the first police radio dispatcher presented to the public ear, his was the voice that actors went to when called upon for a radio dispatcher role. The iconic television series Dragnet, with LAPD Detective Joe Friday as the primary character, was the first major media representation of the department. Real LAPD operations inspired Jack Webb to create the series and close cooperation with department officers let him make it as realistic as possible, including authentic police equipment and sound recording on-site at the police station. Due to Dragnet's popularity, LAPD Chief Parker "became, after J. Edgar Hoover, the most well known and respected law enforcement official in the nation". In the 1960s, when the LAPD under Chief Thomas Reddin expanded its community relations division and began efforts to reach out to the African-American community, Dragnet followed suit with more emphasis on internal affairs and community policing than solving crimes, the show's previous mainstay. Several prominent representations of the LAPD and its officers in television and film include Adam-12, Blue Streak, Blue Thunder, Boomtown, The Closer, Colors, Crash, Columbo, Dark Blue, Die Hard, End of Watch, Heat, Hollywood Homicide, Hunter, Internal Affairs, Jackie Brown, L.A. Greece entered World War II on 28 October 1940, when the Italian army invaded from Albania, beginning the Greco-Italian War. The Greek army was able to stop the invasion and even push back the Italians into Albania, thereby winning one of the first victories for the Allies. The Greek successes and the inability of the Italians to reverse the situation forced Nazi Germany to intervene in order to protect her main Axis partner's prestige. The Germans invaded Greece and Yugoslavia on 6 April 1941, and overran both countries within a month, despite British aid to Greece in the form of an expeditionary corps. The conquest of Greece was completed in May with the capture of Crete from the air, although the Fallschirmjäger suffered such extensive casualties in this operation that the Germans abandoned large-scale airborne operations for the remainder of the war. The German diversion of resources in the Balkans is also considered by some historians to have delayed the launch of the invasion of the Soviet Union by a critical month, which proved disastrous when the German army failed to take Moscow.[citation needed] Greece itself was occupied and divided between Germany, Italy and Bulgaria, while the King and the government fled into exile in Egypt. First attempts at armed resistance in summer 1941 were crushed by the Axis, but the Resistance movement began again in 1942 and grew enormously in 1943 and 1944, liberating large parts of the country's mountainous interior and tying down considerable Axis forces. However, political tensions between the Resistance groups resulted in the outbreak of a civil conflict among them in late 1943, which continued until the spring of 1944. The exiled Greek government also formed armed forces of its own, which served and fought alongside the British in the Middle East, North Africa and Italy. The contribution of the Greek war and the merchant navies in particular was of special importance to the Allied cause. Mainland Greece was liberated in October 1944 with the German withdrawal in the face of the advancing Red Army, while German garrisons continued to hold out in the Aegean Islands until after the war's end. The country was devastated by war and occupation, and its economy and infrastructure lay in ruins. Greece suffered more than 400,000 casualties during the occupation, and the country's Jewish community was almost completely exterminated in the Holocaust. Dragnet is a radio and television crime drama about the cases of a dedicated Los Angeles police detective, Sergeant Joe Friday, and his partners. The show takes its name from an actual police term, a "dragnet", meaning a system of coordinated measures for apprehending criminals or suspects. Dragnet debuted inauspiciously. The first several months were bumpy, as Webb and company worked out the program's format and eventually became comfortable with their characters (Friday was originally portrayed as more brash and forceful than his later usually relaxed demeanor). Gradually, Friday's deadpan, fast-talking persona emerged, described by John Dunning as "a cop's cop, tough but not hard, conservative but caring." (Dunning, 210) Friday's first partner was Sergeant Ben Romero, portrayed by Barton Yarborough, a longtime radio actor. After Yarborough's death in 1951 (and therefore Romero's, who also died of a heart attack, as acknowledged on the December 27, 1951 episode "The Big Sorrow"), Friday was partnered with Sergeant Ed Jacobs (December 27, 1951 - April 10, 1952, subsequently transferred to the Police Academy as an instructor), played by Barney Phillips; Officer Bill Lockwood (Ben Romero's nephew, April 17, 1952 - May 8, 1952), played by Martin Milner (with Ken Peters taking the role for the June 12, 1952 episode "The Big Donation"); and finally Frank Smith, played first by Herb Ellis (1952), then Ben Alexander (September 21, 1952-1959). Raymond Burr was on board to play the Chief of Detectives. When Dragnet hit its stride, it became one of radio's top-rated shows. Webb insisted on realism in every aspect of the show. The dialogue was clipped, understated and sparse, influenced by the hardboiled school of crime fiction. Scripts were fast moving but didn't seem rushed. Every aspect of police work was chronicled, step by step: From patrols and paperwork, to crime scene investigation, lab work and questioning witnesses or suspects. The detectives' personal lives were mentioned but rarely took center stage. (Friday was a bachelor who lived with his mother; Romero, a Mexican-American from Texas, was an ever fretful husband and father.) "Underplaying is still acting", Webb told Time. "We try to make it as real as a guy pouring a cup of coffee." (Dunning, 209) Los Angeles police chiefs C.B. Horrall, William A. Worton, and (later) William H. Parker were credited as consultants, and many police officers were fans. Most of the later episodes were entitled "The Big _____", where the key word denoted a person or thing in the plot. In numerous episodes, this would the principal suspect, victim, or physical target of the crime, but in others was often a seemingly inconsequential detail eventually revealed to be key evidence in solving the crime. For example, in "The Big Streetcar" the background noise of a passing streetcar helps to establish the location of a phone booth used by the suspect. Throughout the series' radio years, one can find interesting glimpses of pre-renewal Downtown L.A., still full of working class residents and the cheap bars, cafes, hotels and boarding houses which served them. At the climax of the early episode "James Vickers", the chase leads to the Subway Terminal Building, where the robber flees into one of the tunnels only to be killed by an oncoming train. Meanwhile, by contrast, in other episodes set in outlying areas, it is clear that the locations in question are far less built up than they are today. Today, the Imperial Highway, extending 40 miles east from El Segundo to Anaheim, is a heavily used boulevard lined almost entirely with low-rise commercial development. Aiding and abetting the periodically frantic life in the Gildersleeve home was family cook and housekeeper Birdie Lee Coggins (Lillian Randolph). Although in the first season, under writer Levinson, Birdie was often portrayed as saliently less than bright, she slowly developed as the real brains and caretaker of the household under writers John Whedon, Sam Moore and Andy White. In many of the later episodes Gildersleeve has to acknowledge Birdie's commonsense approach to some of his predicaments. By the early 1950s, Birdie was heavily depended on by the rest of the family in fulfilling many of the functions of the household matriarch, whether it be giving sound advice to an adolescent Leroy or tending Marjorie's children. By the late 1940s, Marjorie slowly matures to a young woman of marrying age. During the 9th season (September 1949-June 1950) Marjorie meets and marries (May 10) Walter "Bronco" Thompson (Richard Crenna), star football player at the local college. The event was popular enough that Look devoted five pages in its May 23, 1950 issue to the wedding. After living in the same household for a few years with their twin babies Ronnie and Linda, the newlyweds move next door to keep the expanding Gildersleeve clan close together. Leroy, aged 10--11 during most of the 1940s, is the all-American boy who grudgingly practices his piano lessons, gets bad report cards, fights with his friends and cannot remember to not slam the door. Although he is loyal to his Uncle Mort, he is always the first to deflate his ego with a well-placed "Ha!!!" or "What a character!" Beginning in the Spring of 1949, he finds himself in junior high and is at last allowed to grow up, establishing relationships with the girls in the Bullard home across the street. From an awkward adolescent who hangs his head, kicks the ground and giggles whenever Brenda Knickerbocker comes near, he transforms himself overnight (November 28, 1951) into a more mature young man when Babs Winthrop (both girls played by Barbara Whiting) approaches him about studying together. Some show tension revolved around whether a contestant would say the "secret word", a common word revealed to the audience at the show's outset. If a contestant said the word, a toy duck resembling Groucho with a mustache and eyeglasses, and with a cigar in its bill, descended from the ceiling to bring a $100 bill. A cartoon of a duck with a cigar was also used in the opening title sequence. In one episode, Groucho's brother Harpo came down instead of the duck, and in another a model came down in a birdcage with the money. Marx sometimes slyly directed conversation to encourage the secret word to come up. The duck was also occasionally replaced with a wooden Indian figure. After the contestants' introduction and interview, the actual game began. Couples chose from a list of 20 available categories before the show, then tried to answer a series of questions within that category. From 1947--1956, couples were asked four questions. 1947--1953 -- Each couple began with $20, wagering part or all of their bankroll for each question. 1953--1954 -- Each couple now began with $0, but selected values from $10 to $100 (in $10 increments). A correct answer added the value of the question to their bankroll, while an incorrect answer did nothing. According to co-director Robert Dwan in his book As Long As They're Laughing, Guedel changed the scoring format because too many couples were betting, and losing, most or all of their money. 1954--1956 -- The format was slightly altered to start each couple with $100. Incorrect answers now cut their bankroll to that point in half. 1956--1959 -- Two couples (reduced from three) answered questions until they either gave two consecutive incorrect responses or answered four consecutive questions correctly for a prize of $1,000. 1959--1961 -- For the last two seasons, couples picked four questions worth $100, $200, or $300 each, potentially winning up to $1,200. Winning at least $500 qualified the team to go for the jackpot question. From 1947--1956, if the couple ended with $25 or less, Marx asked an elementary consolation question for a total of $25 (later $100) which did not count toward the scores. The questions were made easy in hopes that nobody would answer incorrectly, and included such examples as "Who is buried in Grant's Tomb?", "When did the War of 1812 start?", "How long do you cook a three-minute egg?", and "What color is an orange?" The question about Grant's Tomb became such a staple of the show that both Marx and Fenneman were shocked when one man got the question "wrong" by answering "No one". As the contestant then pointed out, Grant's Tomb is an above ground mausoleum. In all formats, one of the two players on the team could keep their half of the winnings while the other risked their half. In this case, all amounts being played for were divided in half. 1947--1956 -- The highest-scoring couple was given one final question for the jackpot, which began at $1,000 and increased by $500 each week until won (reaching $6,000 at least once, in 1952). In the event of a tie, the tied couples wrote their answers on paper and all couples who answered correctly split the jackpot. 1956--1957 -- For a brief period following the format change, couples who won the front game could wager half on another question worth $2,000. 1957--1959 -- Winning couples now faced a wheel with numbers from 1--10, selecting one number for $10,000. The Great Gildersleeve (1941--1957), initially written by Leonard Lewis Levinson, was one of broadcast history's earliest spin-off programs. Built around Throckmorton Philharmonic Gildersleeve, a character who had been a staple on the classic radio situation comedy Fibber McGee and Molly, first introduced on Oct. 3, 1939, ep. #216. The Great Gildersleeve enjoyed its greatest success in the 1940s. Actor Harold Peary played the character during its transition from the parent show into the spin-off and later in a quartet of feature films released at the height of the show's popularity. On Fibber McGee and Molly, Peary's Gildersleeve was a pompous windbag who became a consistent McGee nemesis. "You're a haa-aa-aa-aard man, McGee!" became a Gildersleeve catchphrase. The character was given several conflicting first names on Fibber McGee and Molly, and on one episode his middle name was revealed as Philharmonic. Gildy admits as much at the end of "Gildersleeve's Diary" on the Fibber McGee and Molly series (Oct. 22, 1940). Premiering on August 31, 1941, The Great Gildersleeve moved the title character from the McGees' Wistful Vista to Summerfield, where Gildersleeve now oversaw his late brother-in-law's estate and took on the rearing of his orphaned niece and nephew, Marjorie (originally played by Lurene Tuttle and followed by Louise Erickson and Mary Lee Robb) and Leroy Forester (Walter Tetley). The household also included a cook named Birdie. Curiously, while Gildersleeve had occasionally spoken of his (never-present) wife in some Fibber episodes, in his own series the character was a confirmed bachelor. In a striking forerunner to such later television hits as Bachelor Father and Family Affair, both of which are centered on well-to-do uncles taking in their deceased siblings' children, Gildersleeve was a bachelor raising two children while, at first, administering a girdle manufacturing company ("If you want a better corset, of course, it's a Gildersleeve") and then for the bulk of the show's run, serving as Summerfield's water commissioner, between time with the ladies and nights with the boys. The Great Gildersleeve may have been the first broadcast show to be centered on a single parent balancing child-rearing, work, and a social life, done with taste and genuine wit, often at the expense of Gildersleeve's now slightly understated pomposity. Many of the original episodes were co-written by John Whedon, father of Tom Whedon (who wrote The Golden Girls), and grandfather of Deadwood scripter Zack Whedon and Joss Whedon (creator of Buffy the Vampire Slayer, Firefly and Dr. Horrible's Sing-Along Blog). The key to the show was Peary, whose booming voice and facility with moans, groans, laughs, shudders and inflection was as close to body language and facial suggestion as a voice could get. The North American Free Trade Agreement (NAFTA) is an agreement signed by the governments of Canada, Mexico, and the United States, creating a trilateral trade bloc in North America. The agreement came into force on January 1, 1994. It superseded the Canada -- United States Free Trade Agreement between the U.S. and Canada. In terms of combined GDP of its members, as of 2010 the trade bloc is the largest in the world. NAFTA has two supplements: the North American Agreement on Environmental Cooperation (NAAEC) and the North American Agreement on Labor Cooperation (NAALC). Securing U.S. congressional approval for NAFTA would have been impossible without addressing public concerns about NAFTA's environmental impact. The Clinton administration negotiated a side agreement on the environment with Canada and Mexico, the North American Agreement on Environmental Cooperation (NAAEC), which led to the creation of the Commission for Environmental Cooperation (CEC) in 1994. To alleviate concerns that NAFTA, the first regional trade agreement between a developing country and two developed countries, would have negative environmental impacts, the CEC was given a mandate to conduct ongoing ex post environmental assessment of NAFTA. In response to this mandate, the CEC created a framework for conducting environmental analysis of NAFTA, one of the first ex post frameworks for the environmental assessment of trade liberalization. The framework was designed to produce a focused and systematic body of evidence with respect to the initial hypotheses about NAFTA and the environment, such as the concern that NAFTA would create a "race to the bottom" in environmental regulation among the three countries, or the hope that NAFTA would pressure governments to increase their environmental protection mechanisms. The CEC has held four symposia using this framework to evaluate the environmental impacts of NAFTA and has commissioned 47 papers on this subject. In keeping with the CEC's overall strategy of transparency and public involvement, the CEC commissioned these papers from leading independent experts. Overall, none of the initial hypotheses were confirmed.[citation needed] NAFTA did not inherently present a systemic threat to the North American environment, as was originally feared, apart from potentially the ISDS provisions of Ch 11. NAFTA-related environmental threats instead occurred in specific areas where government environmental policy, infrastructure, or mechanisms, were unprepared for the increasing scale of production under trade liberalization. In some cases, environmental policy was neglected in the wake of trade liberalization; in other cases, NAFTA's measures for investment protection, such as Chapter 11, and measures against non-tariff trade barriers, threatened to discourage more vigorous environmental policy. A member of the Democratic Party, he briefly served as Governor of Georgia (1931--33) before serving in the United States Senate for almost 40 years, from 1933 until his death in 1971. As a Senator, he was a candidate for President of the United States in the 1952 Democratic National Convention, coming in second to Adlai Stevenson. Russell was a founder and leader of the conservative coalition that dominated Congress from 1937 to 1963, and at his death was the most senior member of the Senate. He was for decades a leader of Southern opposition to the civil rights movement. Russell competed in the 1952 Democratic presidential primary, but was shut-out of serious consideration by northern Democratic leaders who saw his support for segregation as untenable outside of the Jim Crow South. When Lyndon Johnson arrived in the Senate, he sought guidance from knowledgeable senate aide Bobby Baker, who advised that all senators were "equal" but Russell was the most "equal"—meaning the most powerful. Johnson assiduously cultivated Russell through all of their joint Senate years and beyond. Russell's support for first-term senator Lyndon Johnson paved the way for Johnson to become Senate Majority Leader. Russell often dined at Johnson's house during their Senate days. However, their 20-year friendship came to an end during Johnson's presidency, in a fight over the Chief Justice nomination of Johnson's friend and Supreme Court justice Abe Fortas in 1968. While a prime mentor of Johnson, Russell and the then-president Johnson also disagreed over civil rights. Russell, a segregationist, had repeatedly blocked and defeated civil rights legislation via use of the filibuster and had co-authored the Southern Manifesto in opposition to civil rights. He had not supported the States Rights' Democratic Party of Strom Thurmond in 1948, but he opposed civil rights laws as unconstitutional and unwise. (Unlike Theodore Bilbo, "Cotton Ed" Smith and James Eastland, who had reputations as ruthless, tough-talking, heavy-handed race baiters, he never justified hatred or acts of violence to defend segregation. But he strongly defended white supremacy and apparently did not question it or ever apologize for his segregationist views, votes and speeches.) Russell was key, for decades, in blocking meaningful civil rights legislation that might have protected African-Americans from lynching, disenfranchisement, and disparate treatment under the law. After Johnson signed the Civil Rights Act of 1964, Russell (along with more than a dozen other southern Senators, including Herman Talmadge and Russell Long) boycotted the 1964 Democratic National Convention in Atlantic City. A prominent supporter of a strong national defense, Russell became in the 1950s the most knowledgeable and powerful congressional leader in this area. Dragnet is a radio and television crime drama about the cases of a dedicated Los Angeles police detective, Sergeant Joe Friday, and his partners. The show takes its name from an actual police term, a "dragnet", meaning a system of coordinated measures for apprehending criminals or suspects. Dragnet debuted inauspiciously. For example, in "The Big Streetcar" the background noise of a passing streetcar helps to establish the location of a phone booth used by the suspect. Throughout the series' radio years, one can find interesting glimpses of pre-renewal Downtown L.A., still full of working class residents and the cheap bars, cafes, hotels and boarding houses which served them. At the climax of the early episode "James Vickers", the chase leads to the Subway Terminal Building, where the robber flees into one of the tunnels only to be killed by an oncoming train. Meanwhile, by contrast, in other episodes set in outlying areas, it is clear that the locations in question are far less built up than they are today. Today, the Imperial Highway, extending 40 miles east from El Segundo to Anaheim, is a heavily used boulevard lined almost entirely with low-rise commercial development. Premiering on August 31, 1941, The Great Gildersleeve moved the title character from the McGees' Wistful Vista to Summerfield, where Gildersleeve now oversaw his late brother-in-law's estate and took on the rearing of his orphaned niece and nephew, Marjorie (originally played by Lurene Tuttle and followed by Louise Erickson and Mary Lee Robb) and Leroy Forester (Walter Tetley). The household also included a cook named Birdie. Curiously, while Gildersleeve had occasionally spoken of his (never-present) wife in some Fibber episodes, in his own series the character was a confirmed bachelor. In a striking forerunner to such later television hits as Bachelor Father and Family Affair, both of which are centered on well-to-do uncles taking in their deceased siblings' children, Gildersleeve was a bachelor raising two children while, at first, administering a girdle manufacturing company ("If you want a better corset, of course, it's a Gildersleeve") and then for the bulk of the show's run, serving as Summerfield's water commissioner, between time with the ladies and nights with the boys. The Great Gildersleeve may have been the first broadcast show to be centered on a single parent balancing child-rearing, work, and a social life, done with taste and genuine wit, often at the expense of Gildersleeve's now slightly understated pomposity. Many of the original episodes were co-written by John Whedon, father of Tom Whedon (who wrote The Golden Girls), and grandfather of Deadwood scripter Zack Whedon and Joss Whedon (creator of Buffy the Vampire Slayer, Firefly and Dr. Horrible's Sing-Along Blog). The key to the show was Peary, whose booming voice and facility with moans, groans, laughs, shudders and inflection was as close to body language and facial suggestion as a voice could get. The town of Adano is a fictional Sicilian port town modeled after the real town of Licata, one of the disembarkation town of the Allied Occupation of Italy. Just like Adano, the town of Licata has a shipping and sulfur industry, a fishing port, and its largest church is the Church of Sant'Angelo. Additionally, Benito Mussolini did have Licata's 700 year old bell melted to make ammunition.[5] Major Joppolo is based on the American military governor of Licata named Frank E. Toscani. John Hersey visited Toscani for four or five days during the war and created Victor Joppolo from him, even noting that he held a job as a civilian clerk in the New York City Sanitation Department.[6] General Marvin is an obvious depiction of the World War II General Patton, who was known for his bitterness and cruelty, but also his effectiveness. Führer was the unique name granted by Hitler to himself, and this in his function as Vorsitzender (chairman) of the Nazi Party. It was at the time common to refer to party leaders as "Führer", yet only with an addition to indicate the leader of which party was meant. Hitler's adoption of the title was partly inspired by its earlier use by the Austro-German nationalist Georg von Schönerer, whose followers also commonly referred to as the Führer without qualification, and who also used the Sieg Heil-salute.[3] Hitler's choice for this political epithet was unprecedented in German. Like much of the early symbolism of Nazi Germany, it was modeled after Benito Mussolini's Italian Fascism. Mussolini's chosen epithet il Duce or "Dux" if Latin ('the Leader') was widely used, though unlike Hitler he never made it his official title. The Italian word Duce (unlike the German word Führer) is no longer used as a generic term for a leader, but almost always refers to Mussolini himself. After Hitlers' appointment as Reichskanzler (Chancellor of the Reich) the Reichstag passed the Enabling Act which allowed Hitler's cabinet to promulgate laws by decree. One day before the death of Reichspräsident Paul von Hindenburg Hitler and his cabinet issued a decree, that dissolved the office of the president and made Hitler Hindenburg's successor. However this move was in breach of the Enabling Act. Hitler adopted "Führer und Reichskanzler", combining his positions in party and government, as his title.[1][2] Ostensibly Hitler did not use the title "president" out of respect for Hindenburg's achievements as a heroic figure in World War I (though the decree, rather impiously, was already passed before Hindenburg's death on August 2, 1934). In popular reception, the title of Führer and Chancellor was soon understood to mean Head of State and Head of Government -- a view that becomes even more accurate[citation needed] seeing that he was given by propaganda the title of "Führer des deutschen Reiches und Volkes" (Leader of the German Reich and People), the name the soldiers had to swear to. However, it keeps some meaning as "Leader of Party and Head of Government" with reference to the confusing relationship of party and state, including posts in personal union as well as offices with the same portfolio Hitler wanted to fight for his favour. The style of the Head of State was changed on July 28, 1942 to "Führer des Großdeutschen Reiches" ("Leader of the Greater German Reich"). In his political testament, Hitler also refers to himself as Führer der Nation.[4] Nazi Germany cultivated the Führerprinzip (leader principle),[5] and Hitler was generally known as just der Führer ("the Leader"). One of the Nazis' most-repeated political slogans was Ein Volk, ein Reich, ein Führer — "One People, One Nation, One Leader". According to the Constitution of Weimar, the President was Commander-in-chief of the Armed Forces. Unlike "President", Hitler did take this title (Oberbefehlshaber) for himself. When conscription was reintroduced in 1935, Hitler had himself promoted to the new title Oberster Befehlshaber der Wehrmacht (Supreme Commander of the Armed Forces), which meant then a presidential position over the Wehrmacht in fact led by another (newly instituted) Commander-in-chief, the Minister for War. Following the Blomberg--Fritsch Affair in 1938, Hitler took the responsibilities of this commander-in-chief for himself, though he kept on using the older formally higher title of Supreme Commander, which was thus filled with a somewhat new meaning.
