Защита прав потребителей занимает важное место в работе адвоката. Продавцы всеми способами избегают от того, чтобы принять претензию от покупателя, а тем более вернуть ему потраченные на бракованную вещь денежные средства… 1. Начинайте с обращения потребителя, изложите свое требование в письменной форме. При нарушении прав потребителя вы имеете право: вернуть товар, обменять его на аналогичный или уменьшить покупную стоимость, все это касается и услуги. Претензию потребителя необходимо зарегистрировать, или направляйте заказной почтой, в случае отказа в ее получении. 2. Присутствуйте при экспертизе товара, которую инициирует магазин 3. В случае отказа – составляйте исковое заявление о защите прав потребителя и участвуйте в процессе, требуя не только восстановления прав, но компенсации морального вреда, неустойки, штрафа в пользу потребителя и возмещения судебных расходов. Федеральный Закон Российской Федерации от 7 февраля 1992 г. N 2300-I "О защите прав потребителей" ФЗ РФ от 07.02.1992. Статья 11. Режим работы продавца (исполнителя) 1. Режим работы государственных, муниципальных организаций торговли, бытового и иных видов обслуживания потребителей устанавливается по решению соответственно органов исполнительной власти субъектов Российской Федерации и органов местного самоуправления. 2. Режим работы организаций, осуществляющих деятельность в сферах торгового, бытового и иных видов обслуживания потребителей и не указанных в пункте 1 настоящей статьи, а также индивидуальных предпринимателей устанавливается ими самостоятельно. 3. Управление Роспотребнадзора по РА вошло в десятку лучших по России

Главный санитарный врач Республики озвучил первоочередные задачи по улучшению санитарно-эпидемиологическая обстановки в нашем регионе. Пресс-конференция с участием представителей СМИ прошла в Управлении Роспотребнадзора. Кроме того руководитель службы ответил на самые частые вопросы населения. Контрольно-надзорная деятельность, безопасность пищевых продуктов, обеспечение санитарно-эпидемиологического благополучия в образовательных учреждениях. Общаясь с представителями СМИ, руководитель службы Леонид Щучинов отметил, что санэпидемобстановка в регионе во многом зависит от самих жителей РА. Он призвал их более активно защищать свои права, а в случае их нарушений, обращаться в их ведомство. Так, в 2015 году благодаря вмешательству Роспотребнадзора потребителям через суд было возвращено почти пять миллионов рублей, и два миллиона в добровольном порядке. Говоря об основных задачах своего ведомства на 2016 год, Леонид Щучинов отметил совершенствование государственного надзора в области защиты прав потребителей, повышение эффективности контрольно-надзорной деятельности, а так же реализацию мер по профилактике коррупции. Стоит сказать, что в 2015 году Управление Роспотребнадзора по РА вошло в десятку лучших по России, заняв в рейтинге восьмое место.

Качество хлеба вызывает много вопросов у покупателей

Не все ямальские потребители довольны качеством хлеба. Нередко, срок его свежести измеряется часами, а вкус далек от той самой ароматной краюхи. Между тем, в 2016 управлением Роспотребнадзора было снято с производства около 60 килограммов хлеба. Это не более 3% от всех взятых на исследование партий. Почему же хлеб так не нравится потребителю, и какой должна быть настоящая буханка, в специальном репортаже Елены Лысиковой. Смотреть на хлеб равнодушно технолог, бывшего Салехардского хлебокомбината, Татьяна Задорожная не может до сих пор. Тем более, что он поступает на стол школьной столовой, где она теперь работает. Главная претензия к продукту, несоблюдение технологии выпечки. Чтобы тесто созрело, ему нужно не меньше 12 часов. Время - деньги, а их частные пекарни не могут не считать. Единственный муниципальный хлебокомбинат был закрыт в окружной столице 6 лет назад. Хлеб, говорит Татьяна Задорожная, там выпекали строго по ГОСТу. Сегодня в городе около десятка производителей, но, что творится за их дверьми, понять сложно. Попасть на частные предприятия нашей съемочной группе так и не удалось. Не частые гости там и специалисты Роспотребнадзора. Виктория Ткачева - начальник отдела Управления Роспотребнадзора по ЯНАО: «Сейчас в этом году только по жалобам в рамках производственного контроля. А так, раз в три года». В прошлом году в ямальский Роспотребнадзор не поступило ни одной жалобы на качество хлебобулочных изделий. Между тем, вот что ответили обычные прохожие на вопрос, довольны ли вы качеством хлеба в городе: - Отвратительное, если честно. - Я человек сельский, поэтому рада я этому хлебу, а чтоб уже качество - это сильно громко сказано. - Качество не очень хлеба. Из плохого сырья хороший хлеб не сделать, объясняет своим студентам доцент кафедры пищевой биотехнологии Петербургского университета Анатолий Андреев. Автор около полусотни статей, уверяет, сегодня в России весь хлеб делают из муки не того сорта. Под нужные технологические параметры ее, не редко, подгоняют с помощью пищевых добавок. Они позволяют придать хлебу товарный вид, но не вкус. А нередко и объем - это когда привычная на вид буханка имеет меньший вес, но ту же стоимость. Анатолий Андреев - доцент кафедры пищевых биотехнологий Университета ИТМО г. Санкт-Петербург: «Чтобы исправить те недостатки сырья или полуфабрикаты до стабильного и сегодня, и завтра до стабильного мука меняется, тогда делают смешивания разные, тоже может не помочь, тогда добавляют или окислитель, или восстановитель, или ПАВ, то есть регулируют использование их для разных технологий». До 90 года все зерно по качеству делилось на продовольственное и фуражное, которое шло на корм скоту, объясняет ветеран хлебопечения. С перестройкой качество зерна стало падать, и бывший фураж был признан пищевым. Сейчас планку опустили еще ниже. Анатолий Андреев - доцент кафедры пищевых биотехнологий Университета ИТМО г. Санкт–Петербург: «Еще хотят закон депутаты принять об использовании зерна 5 класса. Для хлеба. Это совершенно недопустимо». Однако, по мнению Андреева, в том, что качественного хлеба стало меньше, в какой-то мере виноваты и мы сами. Хороший хлеб не может стоить так дешево. Для состоятельной публики пекари качественный хлеб делать готовы. Найти пекарню с вкусным хлебом сегодня не проблема даже на Ямале. Делается он зачастую из качественной муки и по правильной технологии. И спрос на него совсем не малый. Конкуренция - еще один стимул хлебопекам делать хороший продукт. Однако сегодня в России приходится меньше одной пекарни на 10 тысяч жителей, против 3-4 в Европе. Возможно поэтому, хлебопечка в домах ямальцев становится одним из самых популярных кухонных гаджетов. Геннадий Кучкин - продавец - консультант магазина бытовой техники: «Последнее время хлебопечки стали популярными. Под Новый год особенно у нас раскупили всё. Осталось три модели».

Валентина Матвиенко полагает, что ставка по кредиту на приобретение жилья может составить 6,5 процента годовых. Напомним, в августе 2014 года премьер-министр России Дмитрий Медведев также обещал обратить внимание Центробанка на проблему роста ставок по ипотеке. Об этом он заявил на совещании с главой Минстроя Михаилом Менем. Тогда Мень сообщил, что средняя ипотечная ставка по итогам первого полугодия 2014-го составила 12,2 процента. The radio show Calling All Cars hired LAPD radio dispacher Jesse Rosenquist to be the voice of the dispatcher. Rosenquist was already famous because home radios could tune into early police radio frequencies. As the first police radio dispatcher presented to the public ear, his was the voice that actors went to when called upon for a radio dispatcher role. The iconic television series Dragnet, with LAPD Detective Joe Friday as the primary character, was the first major media representation of the department. Real LAPD operations inspired Jack Webb to create the series and close cooperation with department officers let him make it as realistic as possible, including authentic police equipment and sound recording on-site at the police station. Due to Dragnet's popularity, LAPD Chief Parker "became, after J. Edgar Hoover, the most well known and respected law enforcement official in the nation". In the 1960s, when the LAPD under Chief Thomas Reddin expanded its community relations division and began efforts to reach out to the African-American community, Dragnet followed suit with more emphasis on internal affairs and community policing than solving crimes, the show's previous mainstay. Several prominent representations of the LAPD and its officers in television and film include Adam-12, Blue Streak, Blue Thunder, Boomtown, The Closer, Colors, Crash, Columbo, Dark Blue, Die Hard, End of Watch, Heat, Hollywood Homicide, Hunter, Internal Affairs, Jackie Brown, L.A. Confidential, Lakeview Terrace, Law & Order: Los Angeles, Life, Numb3rs, The Shield, Southland, Speed, Street Kings, SWAT, Training Day and the Lethal Weapon, Rush Hour and Terminator film series. The LAPD is also featured in the video games Midnight Club II, Midnight Club: Los Angeles, L.A. Noire and Call of Juarez: The Cartel. The LAPD has also been the subject of numerous novels. Elizabeth Linington used the department as her backdrop in three different series written under three different names, perhaps the most popular being those novel featuring Det. Lt. Luis Mendoza, who was introduced in the Edgar-nominated Case Pending. Joseph Wambaugh, the son of a Pittsburgh policeman, spent fourteen years in the department, using his background to write novels with authentic fictional depictions of life in the LAPD. Wambaugh also created the Emmy-winning TV anthology series Police Story. Wambaugh was also a major influence on James Ellroy, who wrote several novels about the Department set during the 1940s and 1950s, the most famous of which are probably The Black Dahlia, fictionalizing the LAPD's most famous "cold case", and L.A. Confidential, which was made into a film of the same name. Both the novel and the film chronicled mass-murder and corruption inside and outside the force during the Parker era. The program's heyday was in the early 1950s, when radio actor, producer and director Elliott Lewis took over (still during the Wilcox/Autolite run). Here the material reached new levels of sophistication. The writing was taut, and the casting, which had always been a strong point of the series (featuring such film stars as Orson Welles, Joseph Cotten, Henry Fonda, Humphrey Bogart, Judy Garland, Ronald Colman, Marlene Dietrich, Eve McVeagh, Lena Horne, and Cary Grant), took an unexpected turn when Lewis expanded the repertory to include many of radio's famous drama and comedy stars — often playing against type — such as Jack Benny. Jim and Marian Jordan of Fibber McGee and Molly were heard in the episode, "Backseat Driver," which originally aired February 3, 1949. The highest production values enhanced Suspense, and many of the shows retain their power to grip and entertain. At the time he took over Suspense, Lewis was familiar to radio fans for playing Frankie Remley, the wastrel guitar-playing sidekick to Phil Harris in The Phil Harris-Alice Faye Show. On the May 10, 1951 Suspense, Lewis reversed the roles with "Death on My Hands": A bandleader (Harris) is horrified when an autograph-seeking fan accidentally shoots herself and dies in his hotel room, and a vocalist (Faye) tries to help him as the townfolk call for vigilante justice against him. With the rise of television and the departures of Lewis and Autolite, subsequent producers (Antony Ellis, William N. Robson and others) struggled to maintain the series despite shrinking budgets, the availability of fewer name actors, and listenership decline. To save money, the program frequently used scripts first broadcast by another noteworthy CBS anthology, Escape. In addition to these tales of exotic adventure, Suspense expanded its repertoire to include more science fiction and supernatural content. By the end of its run, the series was remaking scripts from the long-canceled program The Mysterious Traveler. As the first police radio dispatcher presented to the public ear, his was the voice that actors went to when called upon for a radio dispatcher role. The iconic television series Dragnet, with LAPD Detective Joe Friday as the primary character, was the first major media representation of the department. Real LAPD operations inspired Jack Webb to create the series and close cooperation with department officers let him make it as realistic as possible, including authentic police equipment and sound recording on-site at the police station. Some have suggested that "the responsibility for the ultimate failure of this policy [America's withdrawal from Vietnam] lies not with the men who fought, but with those in Congress..." Alternatively, the official history of the United States Army noted that "tactics have often seemed to exist apart from larger issues, strategies, and objectives. Yet in Vietnam the Army experienced tactical success and strategic failure... The...Vietnam War...legacy may be the lesson that unique historical, political, cultural, and social factors always impinge on the military...Success rests not only on military progress but on correctly analyzing the nature of the particular conflict, understanding the enemy's strategy, and assessing the strengths and weaknesses of allies. A new humility and a new sophistication may form the best parts of a complex heritage left to the Army by the long, bitter war in Vietnam." U.S. Secretary of State Henry Kissinger wrote in a secret memo to President Gerald Ford that "in terms of military tactics, we cannot help draw the conclusion that our armed forces are not suited to this kind of war. Even the Special Forces who had been designed for it could not prevail." Even Secretary of Defense Robert McNamara concluded that "the achievement of a military victory by U.S. forces in Vietnam was indeed a dangerous illusion." Doubts surfaced as to the effectiveness of large-scale, sustained bombing. As Army Chief of Staff Harold Keith Johnson noted, "if anything came out of Vietnam, it was that air power couldn't do the job." Even General William Westmoreland admitted that the bombing had been ineffective. As he remarked, "I still doubt that the North Vietnamese would have relented." The inability to bomb Hanoi to the bargaining table also illustrated another U.S. miscalculation. The North's leadership was composed of hardened communists who had been fighting for independence for thirty years. They had defeated the French, and their tenacity as both nationalists and communists was formidable. Ho Chi Minh is quoted as saying, "You can kill ten of my men for every one I kill of yours...But even at these odds you will lose and I will win." The Vietnam War called into question the U.S. Army doctrine. Marine Corps General Victor H. Krulak heavily criticised Westmoreland's attrition strategy, calling it "wasteful of American lives... with small likelihood of a successful outcome." In addition, doubts surfaced about the ability of the military to train foreign forces. Between 1965 and 1975, the United States spent $111 billion on the war ($686 billion in FY2008 dollars). This resulted in a large federal budget deficit. More than 3 million Americans served in the Vietnam War, some 1.5 million of whom actually saw combat in Vietnam. James E. Westheider wrote that "At the height of American involvement in 1968, for example, there were 543,000 American military personnel in Vietnam, but only 80,000 were considered combat troops." Conscription in the United States had been controlled by the President since World War II, but ended in 1973." By war's end, 58,220 American soldiers had been killed, more than 150,000 had been wounded, and at least 21,000 had been permanently disabled. According to Dale Kueter, "Sixty-one percent of those killed were age 21 or younger. Of those killed in combat, 86.3 percent were white, 12.5 percent were black and the remainder from other races." The youngest American KIA in the war was PFC Dan Bullock, who had falsified his birth certificate and enlisted in the US Marines at age 14 and who was killed in combat at age 15. Approximately 830,000 Vietnam veterans suffered symptoms of posttraumatic stress disorder. An estimated 125,000 Americans fled to Canada to avoid the Vietnam draft, and approximately 50,000 American servicemen deserted. In 1977, United States President Jimmy Carter granted a full, complete and unconditional pardon to all Vietnam-era draft dodgers. First broadcast on May 25, 1943, it was restaged seven times (last on February 14, 1960) — each time with Moorehead. The popularity of the episode led to a film adaptation, Sorry, Wrong Number (1948), starring Barbara Stanwyck. Nominated for an Academy Award for her performance, Stanwyck recreated the role on Lux Radio Theater. Loni Anderson had the lead in the TV movie Sorry, Wrong Number (1989). Another notable early episode was Fletcher's "The Hitch Hiker," in which a motorist (Orson Welles) is stalked on a cross-country trip by a nondescript man who keeps appearing on the side of the road. This episode originally aired on September 2, 1942, and was later adapted for television by Rod Serling as a 1960 episode of The Twilight Zone. Here the material reached new levels of sophistication. The writing was taut, and the casting, which had always been a strong point of the series (featuring such film stars as Orson Welles, Joseph Cotten, Henry Fonda, Humphrey Bogart, Judy Garland, Ronald Colman, Marlene Dietrich, Eve McVeagh, Lena Horne, and Cary Grant), took an unexpected turn when Lewis expanded the repertory to include many of radio's famous drama and comedy stars — often playing against type — such as Jack Benny. Lucille Ball was believed to have been the next choice, but she was already committed to My Favorite Husband and didn't audition. Chairman Bill Paley, who was friendly with Arden, persuaded her to audition for the part. With a slightly rewritten audition script--Osgood Conklin, for example, was originally written as a school board president but was now written as the incoming new Madison principal--Arden agreed to give the newly-revamped show a try. Produced by Larry Berns and written by director Al Lewis, Our Miss Brooks premiered on July 19, 1948. The Great Gildersleeve (1941--1957), initially written by Leonard Lewis Levinson, was one of broadcast history's earliest spin-off programs. Built around Throckmorton Philharmonic Gildersleeve, a character who had been a staple on the classic radio situation comedy Fibber McGee and Molly, first introduced on Oct. 3, 1939, ep. #216. The Great Gildersleeve enjoyed its greatest success in the 1940s. Actor Harold Peary played the character during its transition from the parent show into the spin-off and later in a quartet of feature films released at the height of the show's popularity. On Fibber McGee and Molly, Peary's Gildersleeve was a pompous windbag who became a consistent McGee nemesis. "You're a haa-aa-aa-aard man, McGee!" became a Gildersleeve catchphrase. The character was given several conflicting first names on Fibber McGee and Molly, and on one episode his middle name was revealed as Philharmonic. Gildy admits as much at the end of "Gildersleeve's Diary" on the Fibber McGee and Molly series (Oct. 22, 1940). Premiering on August 31, 1941, The Great Gildersleeve moved the title character from the McGees' Wistful Vista to Summerfield, where Gildersleeve now oversaw his late brother-in-law's estate and took on the rearing of his orphaned niece and nephew, Marjorie (originally played by Lurene Tuttle and followed by Louise Erickson and Mary Lee Robb) and Leroy Forester (Walter Tetley). The household also included a cook named Birdie. Curiously, while Gildersleeve had occasionally spoken of his (never-present) wife in some Fibber episodes, in his own series the character was a confirmed bachelor. In a striking forerunner to such later television hits as Bachelor Father and Family Affair, both of which are centered on well-to-do uncles taking in their deceased siblings' children, Gildersleeve was a bachelor raising two children while, at first, administering a girdle manufacturing company ("If you want a better corset, of course, it's a Gildersleeve") and then for the bulk of the show's run, serving as Summerfield's water commissioner, between time with the ladies and nights with the boys. The Great Gildersleeve may have been the first broadcast show to be centered on a single parent balancing child-rearing, work, and a social life, done with taste and genuine wit, often at the expense of Gildersleeve's now slightly understated pomposity. Many of the original episodes were co-written by John Whedon, father of Tom Whedon (who wrote The Golden Girls), and grandfather of Deadwood scripter Zack Whedon and Joss Whedon (creator of Buffy the Vampire Slayer, Firefly and Dr. Horrible's Sing-Along Blog). The key to the show was Peary, whose booming voice and facility with moans, groans, laughs, shudders and inflection was as close to body language and facial suggestion as a voice could get.
